# Terms of Service — Tennis Card Collective

Welcome to Tennis Card Collective ("Tennis Card Collective," "we," "us," or "our"). By accessing or using our website, products, or services (the "Store"), you agree to these Terms of Service ("Terms"). Please read them carefully before using the Store. If you do not agree, do not use the Store.

## 1. General & Eligibility
Tennis Card Collective sells trading cards and related collectible products. By using the Store, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), or are using it with the permission and supervision of a parent or legal guardian who agrees to these Terms, and that you have the legal capacity to enter into a contract. We reserve the right to update, modify, or replace any part of these Terms at any time without prior notice; your continued use of the Store constitutes acceptance of the current Terms.

## 2. Product Information, Condition & Grades
We strive to represent all products accurately through descriptions and images. However, colors, scans, and appearance may vary depending on lighting, screen settings, and photography. Trading cards are collectibles and may contain manufacturing or handling imperfections, including but not limited to print lines, scratches, surface wear, centering issues, edge wear, and corner wear. Unless expressly stated otherwise:

- cards are sold as-is;
- raw (ungraded) cards are not guaranteed to receive any specific grade from a third-party grading company;
- condition descriptions are subjective opinions only and are not guarantees;
- cards should not be assumed to be gem-mint condition;
- **serial-numbered cards are sold as the exact card pictured**; and
- **non-numbered cards may be photographed with a representative image** — you will receive a card of the same player, set, year, and type, but not necessarily the exact card shown. Where a listing uses a representative image, this is stated on the product page.

## 3. Orders, Pricing & Payments
All orders are subject to acceptance and availability. We reserve the right to cancel or refuse any order for any reason, including pricing or typographical errors, inventory inaccuracies, or suspected fraudulent or abusive activity — even after an order has been placed or a confirmation sent. Prices are subject to change without notice. Payments are processed by our third-party payment processor, and by placing an order you authorize the applicable charge and agree to provide accurate billing, shipping, and payment information. You are responsible for any applicable taxes, duties, or fees not collected at checkout.

## 4. Shipping & Delivery
Shipping times shown on the Store are estimates only and are not guaranteed. Orders ship via a tracked service. We are not responsible for shipping carrier delays, lost or stolen packages, tracking interruptions, weather or customs delays, or any delivery issue once the package has been transferred to the shipping carrier. Risk of loss passes to the buyer upon acceptance of the package by the shipping carrier, and a carrier "delivered" scan is treated as proof of delivery.

## 5. Returns
All sales are final. We do not accept returns, exchanges, or refunds for buyer's remorse, change of mind, subjective disagreement over condition or grade, or changes in market value. For orders that arrive damaged, are incorrect, or are not delivered, any issue must be reported within 7 days of delivery (or expected delivery), and the remedy is provided at our sole discretion as set out in our Return Policy, which is incorporated into these Terms by reference.

## 6. Chargebacks & Payment Disputes
If you have any problem with an order, contact us first at tenniscardcollective@gmail.com — we want to resolve it. Initiating a chargeback or payment dispute without first contacting us, or after receiving an item as described (including as-is or representative items), is a breach of these Terms. We reserve the right to contest such disputes with order details, tracking, delivery confirmation, photos, and these Terms, and to refuse future service to any account that files a wrongful dispute.

## 7. Intellectual Property
All content on this website — including logos, graphics, images, product descriptions, text, and branding — is the property of Tennis Card Collective unless otherwise stated, and may not be copied, reproduced, distributed, or used without our prior written permission.

## 8. Third-Party Services
Our store is hosted by [Shopify](https://www.shopify.com) and may integrate with third-party tools and services. We are not responsible for the policies, content, or functionality of third-party websites or services.

## 9. Disclaimer of Warranties
To the fullest extent permitted by law, the Store and all products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

## 10. Limitation of Liability
To the fullest extent permitted by law, Tennis Card Collective and its owners, operators, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Store, the purchase or use of products, shipping issues, product-condition disputes, or delays or interruptions in service. Our total cumulative liability for any claim arising out of or relating to an order shall not exceed the amount you paid for the item(s) at issue.

## 11. Indemnification
You agree to indemnify and hold harmless Tennis Card Collective and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Store, your breach of these Terms, or your violation of any law or third-party right.

## 12. Governing Law & Disputes
These Terms are governed by and interpreted in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Store shall be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction. Any dispute will be conducted only on an individual basis and not in a class, consolidated, or representative action.

## 13. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Return Policy and Privacy Policy, constitute the entire agreement between you and Tennis Card Collective regarding the Store.
